These Terms of Use (“Terms”) govern your access to and use of probly.so (“Probly”, “we”, “us”, “our”). By using Probly you agree to these Terms. If you do not agree, do not use the service.

1. Nature of the service

Probly is a prediction market odds aggregation and display tool. We aggregate publicly available probability data from third-party prediction markets (including Kalshi and Polymarket) and present it in plain English. We do not operate a betting or wagering service, accept wagers, hold funds, or take positions on any outcome.

Nothing on Probly constitutes financial, investment, betting, or gambling advice. All probability figures are derived from third-party market data and reflect crowd sentiment only. They may be inaccurate, delayed, or incomplete. You must not rely on Probly to make financial or wagering decisions.

2. Eligibility — 18+ requirement

You must be at least 18 years of age to use Probly. By using the service you represent that you are 18 or older. Probly contains links to regulated wagering and prediction market platforms; use of those platforms is subject to their own age and eligibility requirements and the laws of your jurisdiction.

3. Accounts

You may browse Probly without an account. Certain features (match alerts, leaderboard participation, Pro subscription) require you to sign in with an email address. You are responsible for keeping your sign-in credentials confidential and for all activity under your account. You must provide accurate information and promptly update it if it changes.

We reserve the right to suspend or terminate your account at any time and without notice if we reasonably believe you have violated these Terms, engaged in abusive or fraudulent conduct, or if we are required to do so by law. On termination your right to use the service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, intellectual property, and governing law) will continue to apply.

4. Free and Pro tiers

Probly is available for free with limited features. A paid Pro subscription (“Pro”) unlocks additional functionality. Subscription fees are charged via Stripe and are stated at the time of purchase. All fees are in USD unless otherwise specified.

Pro subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting hello@probly.so. We do not offer refunds for partial billing periods except where required by applicable law, including the Australian Consumer Law.

5. Affiliate links

Probly displays links to third-party wagering and prediction market platforms (including TAB, Bet365, Sportsbet, and Kalshi). Some of these are affiliate links — if you click through and open an account or place a wager we may receive a commission. Affiliate relationships do not affect the odds data we display. You should read the terms, privacy policy, and responsible gambling information of any third-party platform before registering.

6. User-generated content — paper picks

Probly allows you to submit predictions (“paper picks”). By submitting a pick you grant us a non-exclusive, royalty-free, worldwide licence to display and distribute that pick on Probly, including on leaderboards and in aggregated accuracy statistics. You retain ownership of your picks. You must not submit picks that are unlawful, defamatory, or otherwise harmful.

Paper picks are for entertainment and tracking purposes only. They do not constitute betting advice and do not involve real money.

7. Intellectual property

All content on Probly — including text, logos, design, software, and compiled odds data — is owned by or licensed to Probly and is protected by Australian and international copyright law. You may not reproduce, redistribute, scrape, or create derivative works from any Probly content without our prior written consent.

Third-party marks (TAB, Kalshi, Bet365, Sportsbet, Polymarket, etc.) are the property of their respective owners and are used for identification purposes only.

8. Limitation of liability

To the maximum extent permitted by law, Probly and its operators are not liable for any direct, indirect, incidental, special, or consequential loss or damage arising from your use of the service, including loss arising from reliance on odds data, inability to access the service, or third-party platform conduct.

Where liability cannot be excluded under the Australian Consumer Law or other applicable law, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied. Our total aggregate liability for any claim will not exceed the amount you paid to Probly in the 12 months preceding the claim, or AUD $50, whichever is greater.

Probly is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Dispute resolution

If you have a dispute with us, please contact us first at hello@probly.so so we can attempt to resolve it informally. If we cannot resolve the dispute within 30 days, either party may refer the matter to mediation under the Australian Disputes Centre rules before commencing court proceedings.

Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.

10. Governing law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other mandatory consumer protection legislation.

11. Changes to these Terms

We may update these Terms at any time by posting a revised version at this URL. Material changes will be communicated by email or in-app notice. Continued use of Probly after changes take effect constitutes acceptance of the revised Terms.
